A MAN dropped his tracksuit pants and flashed his buttocks at gardaí.
That was the evidence from Garda Kevin McCarthy against Stephen O’Brien of 25 Evergreen Buildings, Cork, at Cork District Court.
After hearing submissions from defence solicitor, Diarmuid Kelleher, Judge John King asked if O’Brien would do 80 hours of community service instead of going to jail for two months.
O’Brien, aged 30, first indicated he would not be willing to do the community service.
Judge King then imposed the jail term.
However, Mr Kelleher and family members of the accused consulted with the defendant and it was then indicated that he would be willing to do the community service.
The judge agreed to vacate the imprisonment warrant and let the accused do the community service.
During his first submissions, Mr Kelleher said, “There was no physicality. At least he had the good sense to keep away from the guards.”
Judge King replied, “There is nothing remotely resembling good sense here.”
Mr Kelleher said, “There was no physicality, there was just the verbals and the mooning.”
