A 46-year-old man who was convicted of putting his mother in fear was ordered to save up €400 in the next month and bring it to court for his mother.
Judge Aingil Ní Chondúin said she did not want Declan Hallahan of Greenfields, Ballincollig, County Cork to come to court to say he had paid his mother privately at home, the judge wanted the money in court.
The judge said she accepted that the accused had problems. But she said he was able to organise his affairs sufficiently to buy his drink in the pub or off-licence and get drunk and cause his mother problems at home.
“It is time for the nonsense to stop,” Judge Ní Chondúin said.
Hallahan was convicted of contravening a protection order by putting his mother, Breda Hallahan, in fear on September 3.
Judge Ní Chondúin wanted the €400 in Cork District Court in four weeks.
The accused previously said he did not want bail so he has been in custody since September 3. He also did not want to talk to a prison psychiatrist or talk to the probation service.
Joseph Cuddigan, solicitor, said the defendant’s mother had a heart of gold and was letting her son live at home even though he was causing her difficulties when he got drunk.
The judge said, “He is too cosy at home to be living elsewhere. I will take his money.”
Several efforts were made while the accused was in custody to have a psychiatric report prepared on the defendant.
Even as recently as last week, the accused said through his solicitor that he would not see a psychiatrist and would not co-operate with the probation service.
Gardaí arrested Declan Hallahan at his mother’s house at Greenfields, Ballincollig, at around 5.30am on September 3 and charged him breaching the protection order.
